The Technical Regulation ''on safety of chemical products'' (TR EAEU 041/2017) was published on 3 March 2017 and is intended to come into force on 2 June 2021. This deadline is based on the assumption that the secondary legislation (guidance for implementation of TR EAEU 041/2017) would be approved before December 2018. But, the publication of this has been delayed, so there is a possibility that the compliance date may change too. The original intention was that the technical regulation should come into force 30 months after the approval of secondary tier documents. This situation should be applicable to all EAEU member states.
Despite the three year delay, there is still disagreement on two topics: low volume exemption and registration of mixtures. Some member states would include low volume exemption and some want to exclude registration of mixtures.
Four secondary documents remain in the draft phase:
- EEC Decision ‘’on the formation and management of the inventory of chemicals and mixtures of the Eurasian Economic Union, notification of new chemicals and amendments to the Decision of the Council of the Eurasian Economic Commission of March 3, 2017, No. 19'' (EEC Decision);
- Order for the formation and management of the inventory of chemicals and mixtures of Eurasian Economic Union (Inventory Order);
- Order on the notification of new substances (Notification Order); and
- Decision of the EEC board on the transitional provisions of the Technical Regulation of the Eurasian Economic Union ‘’on safety of chemical products’’ (TR 041/2017) (Transitional Decision).
The EEC Decision was originally meant to substitute the decision by which Technical Regulation 041/2017 was approved. It contains transition deadlines for the formation of the register for substances and mixtures depending on the tonnage. The Inventory Order specifies the procedures for the formation and management of the inventory, while the Notification Order addresses the procedures for substance notification. The Transitional Decision further specifies compliance deadlines of different sections of the TR 041/2017.
